As for toe-nailing the inspectors make us put 2 on one side and 3 on the other for a 2x6, that seems like at least one nail too many. Overnailing with toe nails will cause the stud to split. If the wall isn't bearing any load, the cracks wouldn't be a problem with the inspector in my area. If you're concerned and since it's only 3-4 studs, you can cut them out and replace them. Pre-drill holes in the new studs before nailing to minimize splitting.
